1. Acceptance of Terms

By accessing and using Inclusive African Marketplace, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our platform.

2. Marketplace Model

Inclusive African Marketplace operates as a multi-vendor marketplace. Individual vendors list and sell their own products. Inclusive African Marketplace facilitates transactions but is not the seller of record for marketplace items.

3. Shop Owner Liability

Shop owners are solely and fully liable for the goods they list, sell, and deliver through the platform. This includes but is not limited to:

• Product quality, authenticity, and accuracy of descriptions
• Compliance with applicable laws and regulations
• Fulfillment, shipping, and delivery obligations
• Returns, refunds, and customer disputes related to their products
• Any damages, injuries, or losses caused by their products

3A. Seller Responsibility Declaration

Sellers are not required to upload licenses during registration. Before selling, every seller must accept this declaration. Inclusive African Marketplace may later request licenses or supporting documentation for higher-risk categories (such as food, cosmetics, health products, children's products, or any category designated by an administrator).

• I confirm that I am the legal owner or authorized seller of all products listed on Inclusive African Marketplace.
• I acknowledge that I am solely responsible for the legality, authenticity, quality, safety, labeling, importation, licensing, regulatory compliance, taxes, and distribution of all products I sell.
• I confirm that my products comply with all applicable Canadian federal, provincial, and municipal laws and regulations.
• I understand that Inclusive African Marketplace acts only as an online marketplace connecting buyers and sellers and does not manufacture, inspect, certify, or own the products listed by sellers.
• I agree to indemnify and hold harmless Inclusive African Marketplace, its owners, employees, and affiliates from any claims, damages, fines, penalties, recalls, legal actions, or losses arising from my products or my failure to comply with applicable laws.
• I understand that Inclusive African Marketplace may request proof of compliance, business registration, licenses, permits, or other supporting documentation at any time and may suspend or permanently remove my listings or account if I fail to provide them.
• I understand that providing false or misleading information may result in immediate account suspension, product removal, cancellation of orders, and possible reporting to the appropriate regulatory authorities.

Required acceptance: "I have read, understood, and agree to the Seller Responsibility Declaration."

4. Location-Based Orders

Orders are routed to shop owners based on geographic proximity and availability. Shop owners agree to fulfill orders received through the platform in a timely manner.

5. Customer Responsibilities

Customers agree to provide accurate delivery information, pay for orders promptly, and use the platform in accordance with applicable laws.

6. Payments

All payments are processed through our secure payment system. Inclusive African Marketplace may charge platform fees as disclosed at the time of listing or checkout.

7. Alteration Services

Alteration services are provided by third-party tailors. Inclusive African Marketplace is not responsible for the quality of alteration work performed.

8. Returns & Refund Policy

Returns and refunds for marketplace purchases are governed by our Return & Refund Policy. Customers may request returns within 14 days for eligible items; sellers remain responsible for their products, and Inclusive African Marketplace may assist in dispute resolution.

9. Limitation of Liability

Inclusive African Marketplace shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform or purchase of marketplace goods.

10. Privacy

Your personal data is handled in accordance with our Privacy Policy (PIPEDA). Optional nearby-vendor location (IP / GPS) is used only with your consent for discovery; order delivery uses the address you provide at checkout.

Identity verification (KYC): Government ID photos and selfies submitted during business or driver registration are used only to verify your identity for your Inclusive African Marketplace account. They will not be shared with other organizations, sold to third parties, or used for any purpose outside this platform.

11. Modifications

Inclusive African Marketplace reserves the right to modify these terms at any time. Continued use of the platform constitutes acceptance of updated terms.
